By accessing or using RetentionPulse services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

These terms constitute a legally binding agreement between you and RetentionPulse. Your use of our services signifies your acceptance of these terms and our Privacy Policy.

Service Description and Availability

RetentionPulse provides user engagement and retention analysis services for mobile gaming applications. Our platform offers real-time analytics, cohort analysis, predictive insights, and comprehensive reporting tools.

We strive to maintain service availability but do not guarantee uninterrupted access. Services may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

User Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account.

You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to protect your account information.

Acceptable Use and Prohibited Activities

You may use our services only for lawful purposes and in accordance with these terms. You agree not to use our services to violate any applicable laws, infringe on intellectual property rights, or engage in harmful or malicious activities.

Prohibited activities include but are not limited to: attempting to gain unauthorized access to our systems, interfering with service operation, transmitting malware, or using our services for fraudulent purposes.

Intellectual Property Rights and Ownership

RetentionPulse and its licensors own all rights, title, and interest in our services, including all intellectual property rights. You are granted a limited, non-exclusive, non-transferable license to use our services in accordance with these terms.

You retain ownership of your data and content. By using our services, you grant us a license to process and analyze your data to provide our services and improve our platform.

Payment Terms and Billing Policies

Payment for our services is due in advance according to your selected billing cycle. All fees are non-refundable unless otherwise specified in your service agreement or required by applicable law.

We reserve the right to modify our pricing with thirty (30) days' notice. Continued use of our services after price changes constitutes acceptance of the new pricing.

Data Processing and Analytics Services

Our services involve processing and analyzing data from your mobile gaming applications. You represent and warrant that you have the necessary rights and permissions to provide this data to us for processing.

We will process your data in accordance with our Privacy Policy and applicable data protection laws. You are responsible for ensuring compliance with all applicable privacy laws regarding data collection from your users.

Service Limitations and Performance

While we strive to provide accurate and reliable analytics, our services are provided "as is" without warranties of any kind. We do not guarantee the accuracy, completeness, or timeliness of any data or insights provided.

Service performance may vary based on factors including data volume, complexity of analysis, and system load. We will make reasonable efforts to maintain service quality and performance standards.

Termination and Account Suspension

Either party may terminate this agreement at any time with written notice. We may suspend or terminate your access to our services immediately if you violate these terms or engage in prohibited activities.

Upon termination, your right to use our services will cease immediately. We will provide you with access to export your data for a reasonable period following termination, subject to our data retention policies.

Limitation of Liability and Damages

To the maximum extent permitted by law, RetentionPulse shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

Our total liability for any claims arising from or related to these terms or our services shall not exceed the amount paid by you for our services in the twelve (12) months preceding the claim.

Indemnification and Legal Protection

You agree to indemnify, defend, and hold harmless RetentionPulse and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services or violation of these terms.

This indemnification obligation includes reasonable attorney's fees and costs incurred in defending against such claims.

Dispute Resolution and Arbitration

Any disputes arising from these terms or our services shall be resolved through binding arbitration in accordance with the rules of the Brazilian Chamber of Arbitration, conducted in São Paulo, Brazil.

You waive any right to participate in class action lawsuits or class-wide arbitration. Each party shall bear its own costs and expenses in any arbitration proceeding.

Modifications to Terms and Service Changes

We reserve the right to modify these terms at any time. We will provide notice of material changes by posting updated terms on our website and notifying you via email or through our services.

Your continued use of our services after any modifications indicates your acceptance of the updated terms. If you do not agree to the changes, you must discontinue use of our services.

Governing Law and Legal Jurisdiction

These terms are governed by and construed in accordance with the laws of Brazil, without regard to conflict of law principles. Any legal actions or proceedings shall be brought exclusively in the courts of São Paulo, Brazil.

If any provision of these terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
